Terms of Use and Privacy Policy

By using SimulAI, you agree to the terms below. We recommend reading them fully before use.

1. Acceptance

Using the service implies acceptance of these Terms of Use and the Privacy Policy. Acceptance is recorded with date, time, IP address, and the email associated with your account, for evidentiary and compliance purposes.

2. Use of the service

SimulAI lets you create tests from documents (PDF, DOCX, images) and run answer attempts. You are responsible for the content of uploaded files and for ethical use of the system. Do not use the service to violate third-party rights or applicable policies.

3. VideoLab - use of YouTube videos

VideoLab lets you provide a YouTube video link so SimulAI can generate, from the lecture transcript, derivative study material (test, study plan, mind map, and/or chat about the content). By using this feature, you declare and agree to:

  • Strictly personal and educational purpose. Content generated by VideoLab is for your own study and learning. Commercial use, public redistribution, or resale of the derivative material - in whole or in part - is forbidden.
  • Responsibility for access rights. You declare you have a legitimate right to access and use the indicated video for educational purposes (public YouTube video, your own content, or authorization from the rights holder). SimulAI does not verify ownership and is not liable for links submitted in violation of third-party rights.
  • Respect for the original author. Derivative material implicitly cites the transcribed lecture; you commit not to remove references, not to distort the original meaning, and not to present the content as your own to third parties.
  • Allowed content. Do not submit videos with illegal, offensive, discriminatory, hate-inciting, sexually explicit content, or anything that violates YouTube's Terms of Service or applicable law.
  • What we store. SimulAI does not download or host the original video. We store only the video identifier, the generated text transcript, and derivative artifacts (questions, plan, map, conversations). The transcript and relevant excerpts may be sent to AI providers as described in section 4.
  • Limits and removal. We may limit the duration or volume of processed videos according to your subscription plan, refuse to process links that appear to violate these Terms, and remove derivative material at any time upon a substantiated copyright complaint.

Transcript and generated-material accuracy may vary with audio quality, language, and clarity of the original lecture. VideoLab is a study aid and does not replace the original source; always review the generated content critically.

4. Data processed

We process data necessary for service operation: account data (name, email), authentication data, files uploaded for test generation (stored encrypted), attempt answers and results, video links submitted to VideoLab, and transcripts generated from those videos. Part of the content (question and answer text, lecture transcripts) may be sent to AI providers (e.g., OpenAI) for question generation, audio transcription, and improvement tips. Consult those providers' privacy policies for further details.

Login location and audit: For your security and audit purposes, we record the location of each access to your account. The system may use an approximate location from your IP address or, if you authorize it in your browser, a more precise location from your device. This data is used only to identify access origin, detect suspicious access, and maintain session history. We do not use location for marketing nor share it with third parties. Browser location permission is optional: if you decline, we keep using IP-based approximate location.

Advertising on the Free plan: we display ads inside the application (app.simulaiacademy.com) for Free plan users, and one block at the end of blog articles on simulaiacademy.com — no other page of the public website carries an ad. When you consent to advertising cookies in the banner shown on the first authenticated session of the app, browsing data (IP, browser agent, visited page, cookie identifiers) may be shared with Google Ad Manager for ad serving and measurement. We never share with ad networks: quiz content, mind maps, presentations, transcripts, answer keys, or student photos. Full details in section 13 of the Privacy Policy.

5. Security and confidentiality

We adopt technical and organizational measures to protect your data (encryption, access controls, secure development practices). Access to tests and attempts is restricted to your account. We do not share your data with third parties for marketing purposes without your consent.

6. Conduct, reports and sanctions

SimulAI maintains a collaborative community, especially in the Arena (multiplayer mode). To preserve everyone's experience, the following are prohibited - without prejudice to other unlawful conduct: cheating, offensive language, abusive behavior, harassment, inappropriate imagery, spam, or any use of the service to violate third-party rights.

Other users may report you within the platform itself. After review by the moderation team, and depending on severity, recurrence, and context, your account may receive:

  • Warning recorded on your account;
  • Temporary suspension of 1, 3, 7, 15, or 30 days;
  • Permanent ban from the platform.

During a suspension, you cannot log in; active sessions and refresh tokens are terminated immediately. Access is automatically restored at the end of a temporary suspension, or remains blocked in case of a permanent ban.

7. Financial implications of sanctions on paid plans

Practical example: a PRO user who receives a 7-day suspension loses, without refund or cycle extension, the corresponding 7 days of access - even if already paid. The same applies to 1, 3, 15, or 30-day suspensions.

In case of a permanent ban, the remaining balance of paid days in the current cycle is also not refunded, since the sanction arises from a breach of these Terms by the subscriber. Automatic renewals can be canceled at any time in the subscription portal, regardless of any sanction.

This clause is grounded in the subscriber's responsibility for appropriate use of the service and in the contractual breach caused by violation of the conduct rules described above.

Attention - read carefully before accepting: You acknowledge and expressly agree that, if you receive a sanction due to misuse of the service - including, without limitation, cheating, harassment, abusive behavior, offensive language, inappropriate content, or spam - the unused days of your paid subscription during the suspension period will not be refunded, extended, or compensated.

8. Right to contest

If you believe a sanction was applied in error, you can contest it by replying to the notification email sent when it was issued. Upon review by the moderation team, sanctions wrongly applied may be reversed and lost time restored proportionally to the active plan.

9. Changes

We may update these terms and the privacy policy. For material changes, we may request renewed acceptance. Continued use after publication of changes may be deemed acceptance of the new version.

11. Withdrawal of consent (LGPD)

You may withdraw your consent at any time in the app's Settings. Withdrawal does not invalidate processing already performed based on prior consent. To resume using the service, you'll need to accept the terms again.

12. Advertising in the application and the Free plan

To keep the Free plan of the application accessible, we display ads served by a third-party ad network (currently Google Ad Manager, in the rewarded video format) inside the application (app.simulaiacademy.com). On the public website, the only ad sits at the end of blog articles and has nothing to do with your plan. By using the Free version of the application, you acknowledge and agree to the following:

  • Rewarded video to unlock each generation on Free: on the Free plan, each generation of a quiz, presentation, mind map, correction, or video lesson can be unlocked by watching a short video (~15-30 seconds). The video never starts on its own: the screen explains what will happen and you choose between Watch and generate and Cancel. When the video ends, the generation is unlocked immediately. The monthly quota per feature still applies (e.g., 5 quizzes/month), and each unit of quota asks for one video. If you would rather not watch ads, the PRO plan removes all of them.
  • Ad-free areas inside the app: advertising does not appear inside Correction's camera mode, the VideoLab player during a lesson, critical modals (login, payment, profile), the already-started student answer sheet capture flow, or error screens.
  • PRO without ads in the app: PRO subscribers see no rewarded video anywhere in the application. The block at the end of blog articles lives on the public website and does not distinguish plan or login.
  • Personalization (user choice): in the cookie banner shown on the first authenticated session of the app, you can choose between personalized ads (Google uses browsing data to select more relevant creatives) or generic / non-personalized ads (NPA). The choice only affects creative relevance: in both cases, the video remains the way to unlock a generation on Free.
  • Advertiser responsibility: we do not manually select ads. Ad content is determined by Google and its bidding partners. If you encounter an inappropriate ad, report it directly via Google or our contact email.
  • Ad blockers: if a blocker prevents the video from loading, the screen says so and offers to try again later or to subscribe to PRO. We do not ask you to disable your blocker and we do not treat using one as a breach of these Terms.

13. Voice dictation

Voice dictation lets you speak instead of typing in the topic and content fields of practice exams, presentations, mind maps and essays. The feature is optional: typing remains available in all of those fields, and nothing is captured unless you activate the microphone.

  • How it works: when you tap "Dictate", the browser asks for your permission and records only the spoken passage, up to the time limit shown on screen. When you stop, the audio is sent to our API, converted and transcribed. The text appears in the field as editable content — you review it before generating anything.
  • The audio is not stored: the recording exists only in memory and in a temporary file while it is being processed, and is deleted when the request ends, including on error. We do not keep the audio in a database, backup or file storage, and it is not used to train models.
  • Third-party transcription: to turn speech into text, the audio may be sent to a transcription provider — currently Groq, Inc. (Whisper model) and, alternatively, OpenAI — under policies that prohibit using the content to train models. We send only the audio of the dictated passage: no account data accompanies it.
  • Sensitive personal data: a voice recording may qualify as biometric data under the LGPD (art. 5, II). This processing therefore relies on your specific, highlighted consent (art. 11, I), given when you activate the microphone and revocable at any moment. We do not create a biometric identifier from your voice, do not compare it with other recordings, and do not use it to identify you.
  • Minors: if you are under 18, using dictation requires the consent of at least one parent or legal guardian (LGPD, art. 14). Without that consent, please type instead.
  • Accuracy: automatic transcription makes mistakes, especially with acronyms, technical terms, background noise and accents. That is why the text always lands in an editable field and is never used to generate content without your review.

To opt out, simply do not activate the microphone. Nothing else on the platform is limited by that choice.
